Decision summary

Removal by Agreement means that through this process, a registered person can apply to be removed from the Register without being referred to a Panel.

The decision to agree to the application is made at a Case Conference. A registered person can apply for this at any stage in the fitness to practise process.

Applying for removal by agreement does not mean that a registered person has the right to be removed, but it enables Social Care Wales to agree to removal in an appropriate case.

The decision whether to agree the application is made taking into account whether the allegation involves exceptional public interest issues.

Introduction

1. Mr Gareth Roberts registered with Social Care Wales (SCW) as a Domiciliary Care Worker on 18 December 2019.

2. Mr Roberts was employed as a Support Worker by Seren Ffestiniog Cyf.

Allegations

That you, in August 2020, whilst registered as a Domiciliary Care Worker and employed by Seren Ffestiniog Cyf ("Seren")

(1) Withdrew money from the bank account of Individual A without the permission of Individual A for your own purposes.

(2) Your conduct in 1 above, was dishonest.

3. In the course of his employment by Seren, Mr Roberts was supporting Individual A, who was an 80 year old male with mobility problems and mild learning disabilities.

4. On three occasions in August 2020, Mr Roberts withdrew a total of £350 from the bank account of Individual A.

5. Mr Roberts was suspended by Seren after he had attended Seren's office and admitted taking the money from Individual A's bank account, which he repaid.

6. Mr Roberts terminated his employment with Seren by handing in his notice on 28 September 2020.

7. On 24 October 2020, Mr Roberts was given a Community Resolution Order by North Wales Police after he admitted to “financial abuse of a vulnerable adult”.

8. Mr Roberts was referred to SCW by Seren on 7 January 2021.

9. Mr Roberts has applied for removal of his registration by agreement. This statement of agreed facts has been prepared for the purpose of that application.

10. Mr Roberts confirms his agreement to the facts set out in this statement

11. Mr Roberts confirms that it is not his intention to work in the future in any capacity which would require him to be registered by SCW and that he wishes his name to be removed from SCW's register by agreement under Rule 9 of the Investigation Rules 2020.

12. If, contrary to his expressed intention, Mr Roberts should make an application for registration with SCW at a future date, Mr Roberts acknowledges that SCW may have regard to the contents of this statement when considering such an application.
