Consultations - Regulation and Inspection

Phase 1

The first phase of regulations was open for consultation from 28 June until 20 September 2016.

This first phase considered six sets of regulations relating to workforce regulation, three sets related to service and a further set relating to local authority social services’ annual reports. Read the summary of responses to the consultation.

Phase 2

The second phase of regulations focused on the requirements and standards expected of service providers and responsible individuals of care homes; secure accommodation; residential family centre and domiciliary support services.

These were the subject of two consultations:

The service consultation, which ran between 2 May and 25 July 2017

The workforce consultation, which ran between 12 June and 7 August 2017

Statutory guidance, relating to the service provider and responsible individuals regulations was also included within the consultation.

Summary reports were published to coincide with the laying of the regulations in Winter 2017.

The Welsh Government is currently consulting on the Implementation of the Regulation and Inspection of Social Care (Wales) Act 2016.

Draft proposals in the consultation include:

  • mandatory registration of domiciliary care workers
  • opening the workforce register on a voluntary basis to social care workers
  • changing the way that Care Inspectorate Wales decides whether a person is fit and proper to be a service provider

The consultation closes on 16 October 2019.

Phase 3

Draft regulations in respect of fostering services, adult placement (shared lives) services, and certain advocacy services were consulted upon between 24 May and 16 August 2018:

The Welsh Government is currently consulting on the regulation and inspection of adoption services in Wales:

A new regulatory framework for adoption services - consultation ends 27 November 2018

This forms part of phase 3 of implementing the Regulation and Inspection of Social Care (Wales) Act 2016, which is due to come into effect in April 2019.

The Minister for Children, Older People and Social Care has issued a written statement about the consultation.

The Welsh Government is also currently consulting on the amendments to the Adoption Agencies (Wales) Regulation 2005. The consultation ends 9 January 2019.

During the consultation period the Welsh Government will be holding information events:

  • 6 November 2018 in Cardiff
  • 8 November 2018 in Wrexham

The Welsh Government is currently consulting on Amendments to the Regulated Services (Service Provider and Responsible Individuals) Regulations 2017.

The consultation closes on 21 December 2018, with the Regulations due to come into force in April 2019.
